  1. General Provisions

    1. Our personal data processing policy (Privacy Policy) is aimed at protecting the rights and freedoms of natural persons, whose personal data are processed by individual entrepreneur Olemskoy I. A. (hereinafter referred to as the "operator").
    2. The Privacy Policy was developed in accordance with clause 2, Part 1 of Article 18.1 of Federal Law No. 152-FZ dated July 27, 2006 "On Personal Data" (hereinafter referred to as the "Federal Law On Personal Data".
    3. The Privacy Policy, which is a public document, contains information that can only be disclosed pursuant to Part 1 of Article 14 of the Federal Law On Personal Data.

  3. Information about personal data processing

    1. The operator processes the personal data on a legal and fair basis for the purpose of performing the functions, duties and exercising the powers conferred on him by the law, protecting the rights and legal interests of the operator, operator’s employees and third parties.
    2. The operator receives personal data directly from the owners of the personal data.
    3. The operator processes personal data in automated and non-automated ways, with or without the use of computer systems and tools.
    4. Processing of personal data includes collection, recording, systematization, accumulation, storage, updating, modification, extraction, use, transfer (dissemination, provision, access), depersonalization, blocking, deletion and destruction.
    5. The databases of information containing personal data of Russian citizens are located on the territory of the Russian Federation.
  4. Processing of personal data of employees under civil contracts

    1. The operator processes the personal data of employees pursuant to civil law contracts under legal relationships with the operator, regulated by Civil Code No. 14-FZ (part 2) of the Russian Federation, dated January 26, 1996.
    2. The operator processes the personal data of employees under civil law contracts for the purpose of complying with the relevant laws of the Russian Federation, as well as:
      - Concludes and implements civil law contracts with employees;
      - Pays insurance fees into the Pension Fund of the Russian Federation, Social Insurance Fund of the Russian Federation and other bodies;
      - Monitors the quantity and quality of work performed.
    3. The operator processes the personal data of employees under civil contracts with their consent, granted for the duration of the contracts entered with them. In cases stipulated by the Federal Law On Personal Data, consent is granted in writing. In other cases, consent is deemed to have been granted if a contract is signed or if implied-in-fact contract actions are taken.
    4. The operator processes the personal data of employees under civil contracts during the validity period of contracts entered with employees. After the contracts entered with customers have expired, the operator can process their personal information within the period established by clause 5, part 3 of Article 24 (part one) of the Tax Code of the Russian Federation, and Part 1 of Article 29 of the Federal Law On Accounting, as well as other statutory and regulatory enactments.
    5. The operator processes the following personal data of employees under civil contracts:
      — Surname, name, patronymic;
      - Type, series and number of identity document;
      - Date of issue of the identity document and name of issuing authority;
      - Year of birth;
      - Month of birth;
      - Date of birth;
      - Place of birth;
      - Registered address;
      - Contact phone number;
      - E-mail address;
      - Taxpayer Identification Number;

      Number of State pension insurance certificate;
      - Bank details (current account, BIC, correspondent account);
      - Incomes;
      - Position.
    6. In order to achieve the purpose of processing personal data and with the consent of employees, the operator - under civil contracts - provides personal data to or instructs the following persons to process the data:
      - Government bodies (Social Insurance Fund of the Russian Federation, Pension Fund of the Russian Federation, Federal Tax Service);
      - Kontur.Elba (accounting program)).
  5. Processing of personal data of customers

    1. The operator processes the personal data of clients within the framework of legal relationships with the operator, regulated by Civil Code No. 14-FZ (part 2) of the Russian Federation, dated January 26, 1996 (hereinafter referred to as customers).
    2. The operator processes the personal data of clients in order to comply with the laws of the Russian Federation, as well as for the following:
      — enter into and fulfill obligations under agreements with customers.
    3. The operator processes the personal data of clients with their consent, granted for the duration of the contracts concluded with the clients. In cases stipulated by the Federal Law On Personal Data, consent is granted in writing. In other cases, consent is deemed to have been granted if a contract is signed or if implied-in-fact contract actions are taken.
    4. The operator processes the personal data of customers during the validity period of agreements signed with them. After the contracts entered with customers have expired, the operator can process their personal information within the period established by clause 5, part 3 of Article 24 (part one) of the Tax Code of the Russian Federation, and Part 1 of Article 29 of the Federal Law On Accounting, as well as other statutory and regulatory enactments.
    5. The operator processes the following personal information of customers:
      — Registered address;
      — Contact phone number;
      - E-mail address;
      - Taxpayer Identification Number;
      — Name of legal entity;
      — OGRN code;
      — Postal address (for sending originals of documents);
      — Bank details (current account, BIC, correspondent bank account);
      — Surname, name, patronymic;
      — Type, series and number of the document proving the identity;
      — Date of issue of the identity document and name of the issuing authority;
      — Year of birth;
      - Month of birth;
      - Date of birth;
      - Place of birth;
      - Bank details (current account, BIC, correspondent account);
      - ORGN code.
  6. Processing of personal data of individuals: partners

    1. The operator processes the personal information of individuals (partners) within the framework of legal relationships with the operator, regulated by Civil Code No. 14-FZ (part 2) of the Russian Federation, dated January 26, 1996.
    2. The operator processes the personal data of individuals (partners) with a view to:
      — Entering into and fulfilling obligations under agreements;
      — Monitoring the quantity and quality of work performed.
    3. The operator processes the personal data of individuals (partners) with their consent, granted for the duration of the contracts entered with them. In cases stipulated by the Federal Law On Personal Data, consent is granted in writing. In other cases, consent is deemed to have been granted if a contract is signed or if implied-in-fact contract actions are taken.
    4. The operator processes the personal data of individuals (partners) during the validity period of contracts signed with the individuals. After the contracts entered with individuals (partners) have expired, the operator can process their personal information within the period established by clause 5, part 3 of Article 24 (part one) of the Tax Code of the Russian Federation, and Part 1 of Article 29 of the Federal Law On Accounting, as well as other statutory and regulatory enactments.
    5. The operator processes the following personal data of individuals (partners):
      — Surname, name, patronymic;
      — Registered address;

      — Bank details (current account, BIC, correspondent account).
  7. Information about security of personal information

    1. The operator appoints a person that would be in charge of organizing the processing of personal information for performance of duties under the Federal Law On Personal Data and regulatory legal acts adopted in accordance with it.
    2. The operator applies a set of legal, organizational and technical measures to ensure the security of personal data, to ensure confidentiality of personal data and protect them against illegal actions. The measures include:
      — Provides unlimited access to the Privacy Policy, a copy of which is pasted at the operator’s registered address, and may be posted on the operator's website (if available);
      — In compliance with the Privacy Policy, approves and enacts the "Regulation on Personal Data Processing" document (hereinafter referred to as "Regulations") and other local acts;
      — Facilitates employees’ acquaintance with the provisions of the law on personal data, as well as with the Privacy Policy and the Regulations;
      — Provides access for employees to personal data processed in the operator’s information system, as well as to data physical media only for performance of labor duties;
      — Establishes the rules for access to personal data processed in the operator’s information system, and also facilitates registration and recording of all actions carried out with the data;
      — Assesses the harm that may be caused to owners of personal data in the event of violation of the Federal Law On Personal Data;
      — Identifies threats to personal data security during personal data processing in the operator’s information system;
      — Applies organizational and technical measures and uses information protection tools necessary to achieve the established level of personal data security;
      — Detects unauthorized access to personal data and takes response measures, including restoring personal data that were modified or destroyed due to unauthorized access to them;
      — Assesses the effectiveness of measures taken to ensure personal data security prior to commissioning the operator’s information system;
      — Carries out internal control over compliance of personal data processing to the Federal Law On Personal Data, regulatory legal acts adopted in accordance with it, personal data protection requirements, Privacy Policy, Regulations and other local acts, including control over measures taken to ensure the safety of personal data and their level of security when processing them in the operator’s information system.
  8. Rights of owners of personal data

    1. Owners of personal data may:
      — Receive personal data relating to the owner and information relating to processing; - Clarify, block or destroy his personal data if they are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the stated purpose of the processing;
      — Revoke his consent to the processing of his personal data;
      — Protect his rights and legitimate interests, including demanding for compensation for damages and compensation for non-pecuniary damage in court;
      — Appeal against the operator’s actions or omissions at the authorized body in charge of protection of the rights of personal data owners or in court.
    2. To exercise their rights and legitimate interests, owners of personal information may request the operator or send a request personally or through a representative. The request must contain the information specified in Part 3 of Article 14 of the Federal Law On Personal Data.
